Intellectual Property

The Web site and its entire contents, features, and functionality (including but not limited to all information, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by CRHS and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The “Clarkson Regional Health Services” name, the “Clarkson Institute” name, and all related logos and designs are trademarks of CRHS. You must not use such marks without prior written permission from CRHS. All other names, logos, and designs on this Web site are trademarks of their respective owners.

Website Use and Prohibited Use

The Web site is intended for non-commercial use by adults aged 18 and older in the United States.

As a condition of your use of the Web site, you agree to use the Web site and its content only for lawful purposes. You warrant to CRHS that you will not use the Web site or its content for any purpose that is unlawful or prohibited by these Terms of Use. You also agree to maintain and protect your own equipment and Internet/network connection(s). This includes installing and using current antivirus software and firewall protection. We are not responsible for any unauthorized access to your computer or any other system, whether or not you utilize similar security measures.

None of the Web site’s pages or any content may be copied, downloaded, stored in a retrieval system, published, transmitted, or otherwise reproduced, transferred, stored, sold, disseminated, used as a component of or a basis for a database, or otherwise used in any form or by any means. Further, you may not use automated bots to access, scan, scrape, data mine, copy, or use the materials or content on this web site for developing, training, fine-tuning, or otherwise contributing to or improving a machine learning model or artificial intelligence (AI) system or the operation thereof without the express written permission from CRHS.

The inclusion of any link to an external website does not imply our endorsement of the Web site or any association with its operators. Please note that we do not review, control, or take responsibility for the content on external sites. Registered User Accounts

Certain portions of the Web site may be available only to registered users who have registered with the Web site and obtained a password. Remedies

CRHS reserves the right to take any action that it deems reasonably appropriate with regard to the Web site or any content or materials that you post, submit, publish, display, or transmit to other users or other persons (hereinafter, “post”) on or through the Web site (collectively, “User Contributions”). Without limiting the foregoing, CRHS reserves the right to cooperate fully with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Web site. Limitations of Liability

Governing Law and Jurisdiction

All matters relating to the Web site and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of the State of Nebraska without giving effect to any choice or conflict of law provision or rule whether of the State of Nebraska or any other jurisdiction.

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Web site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Nebraska, in each case located in the City of Omaha and County of Douglas, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of personal jurisdiction over you by such courts and to venue in such courts.

Severability

In the event that any court of competent jurisdiction finds any provision of these Terms of Use to be unenforceable as a matter of law for whatever reason, the enforceability of the remaining terms shall not be affected.
